Workplace Accident Claims Solicitors in Manchester

Our job is to establish to what extent your employer is responsible for your work place accident

Work place compensation solicitors

We are experienced in dealing with accidents in the work place

If you’ve been injured in an accident at work that wasn’t your fault then you may be able to make an accident at work claim. Your employer has a legal duty of care to provide a safe working environment and if they fail to do so then you could be eligible for compensation.

Accident at work claims can apply to injuries in one-off accidents or illnesses caused by working conditions over time. In both cases you’ve been let down by your employer, and we understand how devastating that can be.

No amount of compensation can ever truly make up for getting injured while you’re just trying to earn a living. It can be the first step toward getting your life back on track, however, by reflecting how poorly you’ve been treated and ensuring that you don’t suffer financially as a result.

If you’ve been injured in an accident at work then contact the team at TJL. If we think your accident was caused by negligence, we’ll do everything we can to prove it and get the compensation you deserve.

How much Compensation Could I Win From an Accident at Work Claim?

The amount of compensation you could win from an accident at work claim could be anything from a few thousand pounds for minor injuries up to more than a million if you are injured in a way which is life-changing and will require on-going care and attention. You will also receive an amount directly linked to the financial impact of your injuries, to cover things like lost earnings and expenses.

General Damages

General damages are paid on the basis of:

  • The nature of your injuries and how severe they are
  • The physical and psychological pain and distress caused
  • The impact the injuries have on your ability to live your life and do things like pursue hobbies and interests

The figure will be reached using a publication called the Judicial College Guidelines (JCG),  which sets out a range of payments for specific injuries.

Examples in the JCG include:

  • A back injury with permanent serious symptoms - £26,050 to £36,390
  • Moderately severe brain injury - £186,890 to £240,590
  • Serious hand injury - £35,390 - £75,550

The Legal Basis for an Accident at Work Claim

You can make a claim for compensation following an accident in the following circumstances:
  • You were involved in an accident while working
  • The accident happened because your employer was negligent
  • The accident directly caused you to be injured

All UK employers have to comply with the Health and Safety at Work Act 1974 as well as other guidance on specifics such as working at height and operating certain equipment. If they fail to meet the standards set out in law – which means failing to provide a safe working environment – then you could be able to claim compensation.

The failure in question could involve not training you for a task, supplying faulty equipment, not carrying out a risk assessment or not supplying personal protective equipment (PPE). If your employer failed in their duty of care in any way then you may be able to make an accident at work  claim

Do You Handle Accident at Work Claims on a 'No Win No Fee' basis?

Yes, we handle accident at work claims on a no win no fee basis. In simple terms this means the following:
  • You pay nothing up front, or while we work on your accident at work claim
  • You only every pay anything if you receive compensation, and never more than 25% of the compensation awarded
  • If you lose the case, costs will be covered by insurance we take out on your behalf

Our no win no fee approach means you can claim compensation for an accident at work if you‘ve been let down by your employer without having to worry about costs. You’ll never be out of pocket, and if you win you’ll keep the majority of the compensation awarded.

Special Damages

‘Special damages’ is the name given to the compensation intended to cover the financial impact of an accident at work.

This will include any earnings or pension provision lost because of the impact of your injuries on your ability to earn a living.

It will also include any expenses which are directly linked to your injuries, such as the following:

  • Money you have to spend on medical treatment
  • Money you have to spend on adapting your home or vehicle to make allowances for your injuries
  • Money you have to spend on equipment such as mobility aids
  • Money spent travelling to and from any medical appointments linked to your injuries
  • Money you have to spend on care services because of your injuries
  • Money you have to spend on counselling or therapy as a result of your injuries

Special damages will also include an amount to compensate for any time spent by friends and family providing care for you free of charge. As experts in accident at work claims we will always work to get the maximum amount of compensation you are entitled to, which is why we’ve won more than £43 million for our clients over the years.

We secured over £800,000 in work place accident settlement

We represented a male in his forties who suffered a building site injury so serious that his left foot had to be partially amputated. Liability was initially denied but we worked on behalf of the client and were eventually offered £837,500 in compensation – £237,500 more than the initial offer we refused to settle for.

The Type of Work Accidents you can claim Compensation For

  • Industrial accidents

The Accident at Work Claim Process

We understand that taking legal action following an accident at work might be the last thing on your mind.

That’s why we approach each case in a supportive and empathetic manner, taking the work and admin of building the claim out of your hands, and leaving you free to concentrate on making the fullest possible recovery.

One of the ways we do this is by breaking the claims process down into a series of individual steps:

  • Seek medical attention as soon as the accident takes place. As well as treating your injuries and increasing the chances of recovery, prompt medical attention will create an official record of the extent and nature of your injuries.
  • Report the accident to your employers. Many employers have an accident book to log workplace accidents in. if this is the case, ensure that your entry is 100% correct before signing it.

If your workplace doesn’t have an accident book, email a detailed account of your injuries and how the accident happened to your employers as soon as you can.

  • Contact the team at TJL with the details of your accident at work. If we think it sounds like you’ve been the victim of negligence we’ll explain the claims process and get to work gathering evidence on your behalf.
  • We will arrange a medical examination with an independent expert, to ascertain exactly how serious your injuries are and the kind of recovery, if any, you can be expected to make.
  • We will contact your employer informing them of your intention to seek compensation for your workplace accident. In most cases an employer – or the insurers representing them – will admit liability and make an offer of compensation. We use our dispute resolution skills and track record of success to settle claims as quickly as possible and without having to go to court in the vast majority of cases.
  • If your employer admits liability we will negotiate a fair compensation offer. We know exactly what you should be entitled to and will never settle for anything less than 100% of the compensation you deserve.
  • In some cases – particularly those involving more serious injuries – it may take some time to agree a final compensation amount. If this happens we will apply for interim payments to cover costs such as care and medical bills, enabling you to concentrate on your recovery until the final compensation amount is agreed.
  • In a small number of cases an employer might deny liability or refuse to offer fair compensation. If this happens your accident at work claim will be settled in court, and the TJL team will be by your side throughout, making the strongest possible argument for compensation.

How to Make a Personal Injury Claim

Most personal injury claims follow a similar process, whether you were hurt at work, in a road traffic accident, while cycling, or in a public place. But no two claims are exactly the same.

What Counts as a Personal Injury Claim?

A personal injury claim can arise when someone else’s negligence causes your injury. This could be a careless driver, an employer, or a business that failed to fix a dangerous condition. But whether you have grounds to make a claim depends on how the accident happened and who is responsible. Not every accident necessarily leads to a valid personal injury claim.

  • Your medical records, including the attention you received following your accident and treatment you’ve had since
  • A report from the medical examination we arrange
  • Copies of the accident report filed with your employer, either in the accident book or as an email

Accident at Work FAQs

How long after an accident at  work can I make a claim?

In most cases you have to make a compensation claim within 3 years of an accident at work happening. In the case of an illness caused by negligence in the workplace, the 3 year limit will run from the date of diagnosis.

Exceptions to this 3 year rule include:

  • You were under 18 at the time of the accident, in which case the 3 years will run from your 18th birthday to your 21st
  • You were ‘mentally incapacitated’ at the time of the accident and unable to claim within the 3 years

It is also possible that the faulty equipment which caused your injury didn’t come to light until a later date. In this case the 3 year limit will run from the date on which the link between your injury and the faulty equipment became apparent.

How long does the accident at work claim process take?

We always work to process claims as quickly as possible, and if your injuries are relatively minor and liability is admitted the claims process could take 6-9 months. In more complex cases requiring in-depth medical evaluations, or those cases in which an employer denies liability, the process could take over a year.

In all cases we will provide our estimate of how long the process could take throughout, informing you immediately if any change in circumstances means it could take more or less time.

Who pays out for my accident at work claim?

If you receive compensation following an accident at work it will be paid through Employer’s Liability Insurance which all UK employers have to carry, with cover of at least £5 million.

Will I be required to undergo medical evaluations as part of the claim process?

Yes, we will arrange a medical evaluation as part of your accident at work claim. This is so we can pull together the fullest possible picture of the injuries you received, the impact they have had on your life and the degree to which you are expected to recover.

What needs to be legally proven to win my accident at work claim?

In order to win an accident at work claim you need to prove the following:

  • You were involved in an accident at work
  • The accident directly led to your injuries
  • The accident happened because your employer was negligent in some way, and failed in their duty of care to provide a reasonably safe working environment

Can I still claim if I am still fit for work after the accident?

Yes you can still claim if you are fit for work after your accident. Your injuries could have a significant impact on you without stopping you working altogether. An injury to your leg, for example, wouldn’t necessarily stop you working with your hands.

Can I be disciplined or dismissed from my work if claiming against a present employer?

It is against the law for an employer to sack you or force you out of work because you are claiming compensation. If this happens there is a chance you could claim for wrongful dismissal.

Can I still claim if the accident was partly my own fault?

Yes, you can still claim if the accident at work was partly your fault, as long as your employer was primarily to blame. If you are found to have been 20% responsible for the injuries you received (perhaps because you neglected to wear PPE, for example) then the compensation awarded would be reduced by 20%.
