Being injured in a cycling accident is a traumatic and stressful experience. If the accident happened because someone else was negligent, then you may be in a position to make a cycling accident claim.

The compensation you might get following a cycling accident claim can never truly make up for the injuries you received, but it could help you to get your life back on track. We also understand that a successful compensation claim could provide a sense of closure by marking that fact that you’ve been injured through no fault of your own.

If you’ve been injured while riding your bicycle because someone else was negligent then contact the team at TJL.

Our personal injury experts have helped more than 10,000 clients, and if we think you have a strong claim for compensation then we’ll work closely with you to try and get the maximum you deserve.

How Much Compensation Could I Receive Following a Cycling Accident?

In simple terms the compensation paid following a cycling accident caused by neglect could range from a few thousand pounds for minor injuries up to hundreds of thousands for serious injuries which have a permanent impact on things like your ability to earn a living.

The amount of compensation paid following a successful cycling accident claim will reflect the nature of the injuries received, how severe those injuries are and the impact the accident has had on your life in general. We’ve seen time and again that a compensation payment, as well as reimbursing any expenses a cycling accident has caused, can help to ease the psychological effect of the injuries received and speed the recovery process.

The compensation following a successful cycling accident claim consists of two sums – general damages and special damages:

General Damages

The amount of general damages paid is a direct reflection of your injuries, and will be based on the following:

  • Where you were injured and how severe those injuries are
  • The pain and suffering you have gone through as a result of the injuries
  • Whether you are likely to make a recovery from those injuries in the future
  • The degree to which your injuries stop you from pursuing leisure interests, hobbies and family life

The final figure will be based on data published in the Judicial College Guidelines (JCG). The amounts in the JCG apply to the full range of physical injuries likely to be included in a cycling accident claim, from the relatively minor to the life-changing.

Once we’ve established the type and severity of your injuries we’ll be able to make an informed estimate of the general damages we think you could receive. We work in a completely transparent manner and will keep you fully informed if this estimate changes at any time during the claims process.

Special Damages

Special damages are intended to ensure that your cycling accident doesn’t leave you financially worse off than you would have been if your injuries had never been sustained. The amount will include compensation to cover any earnings lost because your injuries mean you can’t work as much, have to change jobs or are forced to stop working altogether.

Special damages are also calculated on the basis of expenses which are directly caused by the injuries received in a cycling accident. These expenses could include the following:

  • Medical costs arising from your injuries now and in the future
  • Care costs arising from your injuries now and in the future
  • The costs of any adaptation needed for your home or vehicle on the basis of the impact your injuries have
  • Any money that has to be spent on special equipment required due to your injuries, such as mobility aids
  • An amount based on any time given up by your friends and family to provide care free of charge
  • The costs of any travel linked to your injuries, such as journeys to and from medical appointments
  • Money you have to spend repairing or replacing the bicycle involved in the accident
  • Money you have to spend to access therapy or counselling as a result of your cycling accident

Examples of suggested compensation amounts include the following:

  • Serious leg injuries - £47,840 -£66,920
  • Severe back injury with spinal cord damage - £85,470 to £151,070
  • An injury to the hip or pelvis which requires surgery - £33,430 to £44,790
  • Serious knee injury - £85,100 - £117,410

Common Cycling Accident Injuries...

The injuries we most commonly have to take into account when making cycling accident claims include:

  • Cuts, bruises and scrapes which happen when a rider is knocked from their bicycle and onto the road
  • Muscle strains, twists, pulls and other injuries to soft tissues caused by the impact of a cycling accident
  • Head injuries ranging from concussion and minor cuts up to fractures and brain damage
  • Injuries to the spine up to and including paralysis
  • Fractures across the body

Depending upon the nature of your cycling accident, the injuries sustained could be anything from bruises, cuts and sprains which take weeks and months to get over, to serious, life changing injuries which call for on-going care or medical attention.

If you suffer any injuries as the result of a cycling accident that wasn’t your fault then . We’ll explain whether you have the grounds to seek compensation and, if you do, how we can help you to make your claim.

How No Win No Fee Cycling Accidents Work

When we take on a cycling accident claim we work on a no win no fee basis. This is sometimes called a Conditional Fee Arrangement (CFA) and means the following:

  • You don’t have to pay anything up front or while we build your case. We take out After the Event (ATE) insurance to cover any costs if your claim is unsuccessful.
  • We only charge our own legal fees if your cycling accident claim is successful
  • We’ll never charge more than 25% of any compensation you’re awarded, leaving you free to walk away with the remaining 75%

Our no win no fee approach is based on a belief that anyone caught up in a cycling accident that isn’t their fault should be able to seek the compensation they are owed without having to stop and worry about cost or fees.

There are no up-front fees or hidden costs when you work with TJL, just a team of experts dedicated to supporting you when you’ve been injured because another party behaved negligently.

How to Make a Personal Injury Claim

Most personal injury claims follow a similar process, whether you were hurt at work, in a road traffic accident, while cycling, or in a public place. But no two claims are exactly the same.

What Counts as a Personal Injury Claim?

A personal injury claim can arise when someone else’s negligence causes your injury. This could be a careless driver, an employer, or a business that failed to fix a dangerous condition. But whether you have grounds to make a claim depends on how the accident happened and who is responsible. Not every accident necessarily leads to a valid personal injury claim.

How to Make a Cycling Accident Claim

In the aftermath of a cycling accident, as you recover from your injuries and come to terms with what’s happened, the mechanics of making a compensation claim are probably the last thing you want to be thinking about. We understand that legal action of this kind can seem daunting, and so we’ll guide you through the process one step at a time.

If you have any questions or concerns as your claim is progressing a member of our team will be on hand to deal with them personally, using clearly understood English rather than confusing legal jargon.

Immediately following any cycling accident you should seek medical attention, even if your injuries seem minor. Prompt medical help will alleviate any pain, increase your chances of making a recovery and create an official record of your injuries.

Any cycling accident involving injuries has to be reported to the police. The police report of the accident can then be used in support of your compensation claim.

You should exchange contact information with any driver, cyclist or pedestrian involved in your cycling accident, including insurance details were applicable. If there are any witnesses to the accident you should also ask for their contact information as witness statements can play an important role in establishing the negligence of another party.

If possible you should take photographs of the scene of your cycling accident, including any other vehicles involved.

Once you have reported the accident and received medical attention you should contact TJL. We have a team of experts waiting to deal with your claim, and if we think you’re entitled to compensation we won’t waste any time in getting the claims process started.

We work on a no win no fee basis, so you won’t have to pay anything up front, or while we get to work gathering the evidence needed to support your claim. This will include the following:

  • Your own detailed account of how the cycling accident happened and the way in which the injuries you received have impacted on your life
  • A medical examination carried out by an independent expert we select to evaluate your injuries and set out the prognosis for any future recovery
  • Records of any other medical appointments or treatments you have had as a result of your injuries
  • The accident report produced by the police who attended the scene
  • Statements from any witnesses to the accident
  • Any photographic record of the location and/or aftermath of the cycling accident. If any CCTV footage of the accident taking place is available we will also get hold of that to back up your account.
  • Any correspondence you may have had with insurance company of the other party involved in the claim
  • Documents setting out the financial impact the accident has had. These could include pay slips, bank statements, bills, invoices and receipts.
  • We will encourage you to keep a contemporary account of the impact of your injuries on a day to day basis and of your recovery following the accident

We will get in touch with the other party to inform them that you intend to claim compensation on the basis of your injuries. We will present the evidence gathered to support your claim, and point to our own track record of handling successful claims of this kind.

We always present the strongest, most persuasive case possible, and in many cases this is enough for the other party to admit liability and offer compensation. If this happens we will negotiate on your behalf to get 100% of the compensation we think you’re entitled to.

We’ve claimed more than £43 million in compensation for our clients, and we never settle for anything less than every penny that you deserve. If liability has been admitted but the exact amount needs to be finalised – which can be the case with more complex injuries requiring in-depth investigation – we will apply for interim payments.

Interim payments can be used to cover the immediate costs of treatment and care, and ensure that the process of recovering from your injuries gets off to the best possible start.

In the small number of cases in which the other party denies liability or refuses to offer fair levels of compensation, your claim will be settled in court. If this happens we’ll support you throughout, standing by your side to offer the strongest possible case on your behalf.

How Long Will a Cycling Accident Claim Take?

The length of time it takes to make a cycling accident claim will vary depending upon factors like the nature of your injuries and how the accident happened.

If the other party admits liability and your injuries are relatively minor then your cycling accident could be dealt with in just a few months.

If more evidence needs to be gathered because the other party denies liability, or due to the complex nature of your injuries, then the claim could take more than a year to be processed. We always work to handle claims as quickly as possible while seeking the maximum in compensation.

We win more than 95% of the personal injury compensation cases we take on because we know exactly what evidence to gather and how to present it, and our track record helps to ensure that the majority of claims we take on are settled out of court.

Is there a time limit to making a cycling accident claim?

There is a time limit of 3 years following a cycling accident, after which you will no longer be entitled to make a claim.

. The occasional exceptions to the 3 year rule include the following:

  • If you (or your child) were under 18 at the time of the cycling accident then the 3 year limit will run from the date of your 18th birthday to that of your 21st
  • If you were ‘mentally incapacitated’ following the cycling accident and so were unable to claim before the 3 years passed. In this case the 3 years will run from the date upon which you regain the mental capacity to make a claim.

Despite the 3 year limit we would always recommend starting your compensation claim as soon as possible after the date of your cycling accident.

The Legal Basis for a Cycling Accident Claim

In legal terms, you could be eligible to make a claim for cycling accident compensation if you meet the following criteria:

  • You were involved in a cycling accident
  • The accident you were involved in happened because someone else behaved in a negligent manner
  • As a direct result of this accident you suffered injuries

The other party involved in a cycling accident could include, but not be limited to, the following:

  • Someone driving a motor vehicle
  • Someone else riding a bicycle
  • A pedestrian
  • Someone responsible for issues with the surface of a road, such as a pothole which causes you to come off your bicycle

The majority of cycling accident claims happen because the driver of a motor vehicle was negligent. We can still handle claims of this kind if the driver in question is uninsured or can’t be traced.

We can also handle cycling accident claims on behalf of a child who is injured or if a loved one sadly dies as the result of a cycling accident. In all circumstances we’ll provide the legal expertise needed to build a cycling accident claim, combined with the support you’ll need at what is bound to be a difficult time.

Cycling Accident FAQs

Can I claim for a cycling accident if the other party was uninsured or can’t be traced?

Yes, you can claim for a cycling accident if you can’t trace the party responsible, or they were an uninsured driver. Cases like this are dealt with by the Motor Insurer’s Bureau (MIB), a government body that supports the victims of uninsured drivers.

The only difference in the process of making a claim through the MIB is that the details of your claim will have to be uploaded through the ‘portal’ of the MIB website.

Will I need to attend court as part of my cycling accident claim?

You will have to attend court if your cycling accident claim is one of those rare cases in which the other party denies liability or refuses to offer a fair level of compensation. If this happens, the support and legal expertise of the team at TJL will be more important than ever.
