How to Start Your Road Traffic Accident Claim

We understand that starting a road traffic accident claim following an accident might be the last thing on your mind. The physical and psychological impact of your injuries could mean that you find the thought of starting legal action to be daunting.

Our experience of claiming compensation for more than 15,000 people means that we understand how difficult the aftermath of a road traffic accident can be. We’ll work closely with you as you make your claim, doing the work on your behalf and breaking the process down into a series of smaller steps.

In the immediate aftermath of a road traffic accident you should do the following:

  • Seek medical attention to alleviate your pain and suffering and create an official record of your injuries
  • You have a legal duty to report any accident in which people are injured to the police. The report created by the police will then play a part in your compensation claim.
  • You should exchange details with the other people involved in the road traffic accident, including insurance details with any drivers, as well as the registration numbers of any vehicles involved
  • If you can you should gather visual evidence in the form of photographs of the scene of the accident and any other vehicles involved
  • You should contact the team at TJL at the earliest opportunity. We’ll listen to the details of your road traffic accident and if we think you have the right to claim compensation for negligence we’ll start the process of making a road traffic accident claim immediately.

We will need to establish the specific details of your accident. We may ask some of the following;

  • What do you think caused the accident?
  • How was the other driver’s driving before the accident?
  • Do you have any footage of the accident from a helmet or dash cam?
  • Were there any witnesses to the accident?
  • Where were you driving at the time of the accident and who was in the car with you?
  • Did you have a conversation with the other driver after the accident and if so, what was said?
  • Did the police attend the scene of the accident?

The Amount of Compensation You Can Claim for a Road Traffic Accident

Any damages awarded will be made up of general damages and special damages, which are calculated in the following way:

The amount of compensation you could claim for a road traffic accident can range from a few thousand pounds for minor injuries up to more than a million for life changing injuries such as the loss of a limb.

General Damages

General damages are intended to reflect the nature and severity of your injuries, the impact they will have on your ability to live your life and the prognosis for any recovery. A publication called the Judicial College Guidelines (JCG) sets out recommended ranges of payment for specific injuries, including the following:

  • Moderately severe brain injury – £186,890 to £240,590
  • Serious jaw fracture – £15,320 to £26,010
  • Severe back injury with spinal cord damage – £85,470 to £151,070
  • A fractured index finger causing permanent symptoms – £7,780 to £10,440

Special Damages

Special damages are meant to compensate for the financial impact of a road traffic accident. They are intended to return you to the financial state you would have been in if the accident had never happened, by covering any income or pension lost because of your injuries, as well as any direct expenses they cause.

Expenses covered by special damages include the following:

  • The costs of any medical treatment needed because of your injuries now and in the future
  • The costs of any care required because of the impact of your injuries, now and in the future
  • An amount to factor in care provided free of charge by your friends and family
  • The cost of any adaptations made to your home or vehicle on the basis of your injuries
  • The cost of a specialised equipment needed, such as wheelchairs and mobility scooters
  • Travel costs to and from any medical appointments related to your injuries

The Evidence Required for a Successful Road Traffic Accident Claim

The evidence for a road traffic accident claim includes the following:

Once we’ve determined that you’re eligible to make a road traffic accident claim we’ll start the process of pulling the evidence together. Although you may come to us with some evidence initially, we’ll handle the task of building up a more detailed case, giving you the room needed to concentrate on recovering while we handle your claim.

  • A statement from you setting out how the accident happened and the ways in which the injuries have impacted you in all parts of your working and family life
  • A medical evaluation carried out by an independent expert of our choosing, creating the fullest possible picture of your injuries and a detailed prognosis for any recovery
  • Your wider medical records and in particular the details of any treatment you received following the accident and in the period since
  • A copy of any report the police produced of the road traffic accident
  • Statements taken from any witnesses to the accident, including bystanders and any other drivers or passengers
  • Photographs taken of the scene of the accident, at the time if possible, and of the road layout and any other contributing factors
  • If the scene of the road traffic accident is covered by a CCTV camera we will try to get hold of any footage available
  • Any correspondence you have with your insurance company or the insurers representing the other parties involved
  • Paperwork to document any expenses which have been directly caused by your injuries. This could include wage slips and bank statements, as well as bills, invoices and receipts.
  • Your own account of the period following the road traffic accident and the process of recovering from your injuries. Keeping details in diary form as they happen will mean that you record all of the ways in which you have been impacted by your injuries as they happen.

Our reputation for surpassing expectations is built upon working tirelessly to deliver great results for our clients.

Serious injuries are all too common in motor vehicle accidents. We will always aim to secure interim compensation to cover the cost of any immediate medical treatment needs and loss of earnings.

The Time Limit for Making a Road Traffic Accident Claim

If you wait any longer you won’t be eligible to make a compensation claim.

There is a statutory time limit for making personal accident claims of this kind and it is 3 years after the date of the road traffic accident.

The few exceptions to this 3 year rule include the following:

  • You were mentally incapacitated during the three year period in question. If this happens, the three year limit will run from the date on which you regain mental capacity.
  • You were under the age of 18 at the time of the road traffic. If this is the case you can make a claim any time between your 18th birthday and your 21st.

Despite the legal time limit of 3 years we would always recommend starting your road accident claim as soon as possible after the accident in question. Memories of the accident will be fresher in your mind and the minds of any witnesses, and the sooner the claim is started, the sooner you’ll get any compensation you are entitled to.

Passenger in a car at the time of road traffic accident

£1,200,000 in compensation secured for man involved in a serious road traffic accident

We acted on behalf of a young man who sustained multiple injuries in a high speed collision, whilst travelling as a passenger in a car. Responsibility for the accident was strenuously denied on the basis that it was alleged his client was aware that the driver of the car was uninsured and had no licence. The seriousness of the injuries suffered lead to a settlement of £1,200,000, which included a claim for care and prosthetics, as it was clear that one of the Claimant’s legs would need to be amputated at a future date. In complex cases like this, it’s very important that you work with a solicitor who has extensive experience of securing high levels of compensation for victims of serious road traffic accidents. At TJL, we have a team who can offer expert advice on serious injury cases, involving the most complex injuries.

The No Win No Fee System Explained

When we handle a road traffic accident claim we do so on a no win no fee basis.

. This is also known as a Conditional Fee Arrangement (CFA) and it works in the following way:

  • You pay nothing up front to TJL, or during the process of gathering evidence, putting your claim together and negotiating a settlement
  • If you win your case you won’t have to pay any legal fees until after the compensation has been paid – even then it will never be more than 25%
  • If you lose your compensation claim the costs owed to the other party will be covered by insurance which we take out on your behalf at the start of the process

We work on a no win no fee basis because we think you should be able to claim for compensation when you’ve been injured through negligence without having to worry about the cost. There are no hidden fees or charges when you work with TJL, just a commitment to doing everything we can to get the compensation you deserve.

Specialists in serious injury claims

Serious Road Traffic Accident

We acted for a 12 year old girl who was involved in a serious road traffic accident when she was hit by a car whilst crossing the road at a zebra crossing. She sustained head injuries and initially it was thought she had made a full recovery. She was initially represented by another firm of lawyers and had been offered around £15,000 for her case. We were instructed after the Court refused to approve that award and further evidence was obtained to support the claim. Ultimately, the case was settled for over £300,000, 20 times the initial sum offered.

The Role of Solicitors in a Road Traffic Accident Claim

The law dealing with personal injury claims and proving negligence is extremely complex, and the team at TJL have more than 25 years’ worth of experience of successfully handling claims of this kind.

There is no legal obligation to work with a solicitor when making a road traffic accident claim, but trying to claim compensation on your own behalf is an extremely risky option.

As soon as you tell us the details of your road traffic accident we’ll be able to say whether you have a strong claim for compensation. If you do, we’ll set out the process in clear, easily understood terms, including the evidence needed and our estimate of how long the claim might take.

As well as dealing with the legal complications of making a road traffic accident claim we will provide empathetic support and advice, including access to help with coping with the psychological impact of being injured. Our expertise will give you the room and time to recover as we concentrate on gathering evidence, building your claim and negotiating a settlement.

We’re used to dealing with the kind of insurance companies who handle road traffic accident claims, and our track record, including a 95% success rate, speaks for itself. As well as knowing what it takes to prove negligence we know exactly what you could claim compensation for, and will never settle for anything less than 100% of what you’re entitled to.

In very rare cases the other party denies liability or refuses to make a fair offer, and if this happens we will fight your claim in court, standing by your side to put forward the strongest possible case.

Young driver wins compensation despite full liability dispute

£200,000 secured for teenager trapped in crushed vehicle

We acted for a young man, aged 19 who was involved in a vey serious road traffic accident whilst travelling to work one morning.

Our client’s vehicle was struck heavily in the rear, whilst stationary in traffic. His car was then forced into the vehicle in front and crush, trapping him inside. He sustained very serious head injuries and spent a lengthy time in hospital. The injuries left our client with long term problems, including memory loss, personality change, memory problems and fatigue.

Liability was disputed in full. The other driver claimed our client cut in front of him, causing the collision.

Expert accident investigation evidence was obtained and multiple medical reports from a number of disciplines, in order to support our client’s claim.

Legal proceedings were issued in the High Court and the case was ultimately settled before trial for damages in the sum of £200,000.

Road Accident Claim FAQs

Can I claim compensation if the road traffic accident was partially my fault?

Yes, you can still claim compensation if a road traffic accident was partially your fault, as long as another party was primarily to blame. The way the law works is that the compensation awarded will be reduced in line with the degree to which you are held responsible.

In simple terms, if you were found to be 20% to blame for the road traffic accident, your final compensation would be reduced by 20%.

How long does the road traffic accident claim process take?

How long your road traffic accident takes will depend upon whether the other party admits liability, and how complex the injuries in question are. If liability is admitted and the injuries are only minor the claim might take just a few months to process.

If the other party denies liability, or the injuries are serious enough to require more in-depth investigation, this timeframe could shift to between 6 and 12 months. In the most complex cases, including head injuries and long term mobility issues, the in-depth medical information needed for a fair settlement means that the claims process could take more than a year.

If liability has been agreed and the question of a fair settlement is causing a delay – i.e. if the medical details of any likely future recovery need to be established – we will apply for interim payments. Any interim payments made in this way will then be deducted from the final compensation payment.

What happens if the other driver involved doesn’t stop or is uninsured?

If you are involved in an accident with another driver who can’t be traced, or who is uninsured you can still make a claim through the Motor Insurer’s Bureau (MIB). This body was set up by the government to handle compensation claims and pay-outs to people impacted by uninsured drivers.

The only difference between this claim and one made from an insured driver is that the details will need to be uploaded via the ‘portal’ on the MIB website.

Can I claim if I was a passenger during a road traffic accident?

Yes, you can make a claim if you are injured in a road traffic accident while travelling as a passenger. A claim of this kind could be made because another driver was negligent, or because of the actions of the driver of the vehicle you were travelling in.

What Counts as a Personal Injury Claim?

A personal injury claim can arise when someone else’s negligence causes your injury. This could be a careless driver, an employer, or a business that failed to fix a dangerous condition. But whether you have grounds to make a claim depends on how the accident happened and who is responsible. Not every accident necessarily leads to a valid personal injury claim.
