A serious injury is one which has a permanent, life-changing impact on the injured person and their family. If you’ve suffered a catastrophic injury of this kind then you may be able to make a claim for compensation.

Claiming compensation for a serious injury is never going to fully make-up for the way in which your life has been turned upside down. What it can do, however, is ensure that you have the resources to get the treatment and care your injuries have left you needing, as well as covering expenses such as home or vehicle adaptations.

Here at TJL we’ve won more than £43 million for our clients, and we understand that making a serious injury claim following an accident caused by negligence can also provide a psychological boost and some sense of closure. If you’ve been seriously injured because another party let you down then compensation can make a huge difference when it comes to getting your life back on track.

The Legal Definition of a Serious Injury

You may be wondering if the injuries you’ve suffered can be classed as a ‘serious injury’. While there is no strict legal definition of a serious injury, there is general agreement that the following criteria apply:

  • The injury has left you unable to live independently
  • The injury called for surgical intervention of some kind
  • The injury required hospital treatment and long term medical care
  • The injury made it difficult or impossible for you to return to work

The process of making a serious injury claim can be more complex and lengthy than a ‘standard’ injury because of the scale and type of the problems caused. More medical evidence is usually required and the amount of compensation awarded will be higher.

Compensation Amounts for a Serious Injury Claim

Any compensation awarded for a serious injury claim could range from tens of thousands of pounds to over a million, as it is meant to reflect the severity of the injuries and their permanent, life-changing impact.

The total amount will be made up of general damages and special damages:

General Damages

General damages are calculated on the basis of the pain and distress your serious injury has caused you and the way in which the injuries stop you from living your life as you previously did. This is called ‘loss of amenity’ and it covers things like not being able to enjoy hobbies, pastimes and family life in general.

The amount of general damages is decided with reference to the Judicial College Guidelines (JCG). This publication sets out a range of payments for every type of personal injury, including serious injuries.

Special Damages

Special damages are more financial in nature, and are intended to ensure that you don’t find yourself financially worse off than if the accident had never happened. An amount will be paid to cover earnings and pension provision lost because of the impact of the serious injury on your working life.

In addition, the special damages are meant to cover expenses directly linked to your injuries, such as the following:

  • The cost of medical treatment now and predicted for the future
  • The cost of care which has to be provided now and predicted for the future
  • The cost of specialised equipment required due to your serious injuries, such as a wheelchair or mobility scooter
  • The cost of adapting your home to account for the long term effect of your injuries, or of having to rehouse altogether
  • The cost of any travel to and from medical appointments related to your injuries
  • The cost of any therapy or counselling your injuries require

Time spent by friends or family providing care free of charge can also be factored in when calculating special damages for serious injuries. Our track record of gaining the maximum compensation for clients making serious injury claims is based on our understanding of exactly what can be claimed for and how to prove the financial impact your serious injuries have had.

Examples from the latest JCG include:

  • A back injury with permanent serious symptoms - £26,050 to £36,390
  • Moderately severe brain injury - £186,890 to £240,590
  • An injury to the hip or pelvis which requires surgery - £33,430 to £44,790

Who Can Claim Compensation for a Serious Injury?

If you’ve suffered a serious injury in the past 3 years and it happened because someone else was negligent in some way then you may be able to make a claim for compensation.

A serious injury claim will be based on the hugely negative impact an injury of this kind will have on your life, including the fact that it might stop you being able to earn a living.

If you’ve been injured and think it might have happened because of negligence, then contact the team at TJL. After you’ve given us the details of your case we’ll know whether you have the right to make a claim, and if you do we’ll explain the serious injury claim process to you and immediately set about working on a no win no fee basis.

Serious injury claims can be based on one-off incidents such as road traffic accidents or longer term problems, such as working conditions which lead to chronic illness. The expert team at TJL have experience of making every type of serious injury claim, from medical negligence claims to accidents in public places.

We know exactly what kind of evidence to gather to show that another party acted in a negligent manner and, as a result, you have suffered a serious injury. We also know exactly what you can claim compensation for, and never settle for anything less than every penny of the compensation our clients deserve.

Which Serious Injury Claims are Made?

As long as you can prove that another party was negligent and caused your injury, you could be able to make a compensation claim for injuries such as:

  • Fractured and broken bones
  • Burns and other scarring
  • Injury through an accident in the workplace
  • Injuries to the back and spine
  • Head Injuries
  • Injuries which cause brain damages
  • Slips, trips and falls leading to serious injuries
  • The loss of limbs or limb function
  • The development of chronic illnesses

You can also make a serious injury claim if a loved one is killed by their injuries. In this case the claim will cover any pain and suffering caused by the injuries suffered by the deceased, as well as the loss of support for any financial dependants.

No Win No Fee Explained

We handle serious injury claims on a no win no fee basis.

In simple terms this means that you pay nothing up front or while your claim is being processed, and will only ever pay anything for our help if your claim is successful.

The ‘success fee’ we take will never be more than 25% of the compensation awarded, leaving you with the rest, and if your case is unsuccessful then any costs will be covered by insurance we take out on your behalf. We think that someone who has been seriously injured through negligence should be able to pursue a fair compensation settlement without having to worry about costs or hidden fees, and that’s exactly what our no win no fee service provides.

How to Make a Personal Injury Claim

Most personal injury claims follow a similar process, whether you were hurt at work, in a road traffic accident, while cycling, or in a public place. But no two claims are exactly the same.

What Counts as a Personal Injury Claim?

A personal injury claim can arise when someone else’s negligence causes your injury. This could be a careless driver, an employer, or a business that failed to fix a dangerous condition. But whether you have grounds to make a claim depends on how the accident happened and who is responsible. Not every accident necessarily leads to a valid personal injury claim.

Your dentist was supposed to fix a problem. Instead, you’re dealing with the consequences of dental treatment that left you worse off, like suffering constant pain or needing further procedures. You want to know: do I have a dental negligence claim?

A Guide to the Process for Making a Serious Injury Claim

Here at TJL we understand just how daunting the thought of making a compensation claim might be.

We’ll work to make things as simple as possible by guiding you through the process one step at a time:

  • Seek medical help for your injuries in the immediate aftermath of any accident. Prompt medical attention could be life-saving in the case of serious injuries, and it will help to establish an official record of when and how you were injured and how badly you were hurt.
  • Report the accident which caused your serious injuries. The relevant body to make the report to could be your employer, an NHS trust, the police in the case of a road traffic accident or a local authority if you were injured in a public place. No matter who you make the report to it will create an official account of the accident and your injuries which will then form part of any compensation claim.
  • Contact the team at TJL if you think the negligence of another party was to blame for your serious injuries. We take an approachable and supportive approach to every compensation claim and we’ll listen to what happened to you and then explain the law that applies to compensation claims. If we think you have the grounds for a serious injury claim we’ll get to work right away. We make our claims on a no win no fee basis which means you don’t have to pay a penny up front for us to start gathering evidence and building the strongest possible claim.

We’ll gather the evidence needed to show that your injuries were caused by negligence, and to demonstrate the severe impact they have had on your life. This evidence could include, but isn’t limited to, the following:

  • A detailed statement from you setting out how you received the serious injuries and the impact they have had on all parts of your life
  • We will arrange at least one medical evaluation with an expert of our choosing. This will establish the full extent of your injuries and the likelihood and extent of any recovery that can be expected.
  • Your existing medical records, and in particular details of any treatment you have needed because of your serious injuries
  • Accounts provided by any eye-witnesses to the accident or working conditions which caused your serious injuries
  • Photographs taken at the scene of any accident, and any CCTV footage which might be available
  • Documents related to the financial impact of your serious injuries. These could include payslips, sickness payments, receipts, bank statements, bills and invoices.

With the evidence in place we will contact the party we feel was negligent and inform them of your intention to claim compensation. In many cases the other party – presented with the strength of your case and our track record of winning serious injury claims – will admit liability and offer to settle.

If the other party admits liability we will negotiate on your behalf for a fair compensation payment. We never settle for anything less than the maximum amount your injuries warrant, and our experience of claiming for more than 15,000 people means that we know exactly how much this should be.

The complex nature of serious injury claims, especially the time it can take to establish the full life-long impact of the injuries, means that it may longer than usual to agree a final fair settlement after liability has been established. Because of this we will seek interim payments ahead of time to cover the on-going costs of coping with your injuries, and give you a better chance of making the fullest possible recovery.

We always work to settle claims out of court using our expertise in dispute resolution and our understanding of personal injury law. If this isn’t possible, however, the claim will have to be settled in court, and the TJL team will stand side by side with you, presenting the strongest possible case for the compensation you’re entitled to.

Do I Need to Work With a Solicitor or Legal Expert for a Serious Injury Claim?

There isn’t a legal obligation to work with a solicitor or legal expert for your serious injury claim, but attempting to claim on your own behalf would be extremely risky.

Serious injury claims are amongst the most complex personal injury claims, requiring a full understanding of not just the law but also the kind of detailed medical evidence required for a successful claim.

Our experts know exactly what it takes to prove negligence in all types of serious injury claim, from accidents in the workplace to medical negligence. We also have a strong track record of negotiating with the kind of bodies likely to be involved in your serious injury claim, from employers through to NHS trusts and local authorities.

In addition to our legal know-how, we have a full understanding of the full psychological impact of a serious injury, and can help to provide support for you and your family while we get on with the vital task of fighting for the compensation you deserve.

Is there a time limit for making a serious injury claim?

There is a legal time limit of 3 years in place on serious injury claims, from the date on which the injury in question happened. If the serious injury takes the form of an illness then the three years starts when the illness is diagnosed.

Exceptions to the 3 year rule include the following:

  • You were ‘mentally incapacitated’ at the time of the injury and so unable to make a claim
  • You were under 18 years of age when you were seriously injured. In this case the 3 years will run from your 18th birthday to your 21st.

What needs to be legally proven to win my serious injury claim?

In order to prove a serious injury claim you need to show the following:

Serious Injury FAQs

How long does the claims process take?

The complex nature of serious injury claims means that they can take longer than other personal injury claims to process – at least 1 to 2 years. Once we know the details of your case we’ll be able to offer an estimate of how long we think it could take, depending upon the complexity of your injuries and the medical evidence needed.

In longer cases we will always try to claim interim payments to help you cope with your injuries until the final settlement is made.

Will I have to undergo medical evaluations as part of the claim process?

Yes, medical evaluations play a part in the serious injury claims process. The evidence of expert medics will help us to establish just how serious the injuries are, and the degree to which they will impact the rest of your life.

Any evaluation will also identify multiple injuries and the ways in which they interact.

Will I be required to attend and/or give evidence in court?

You will only need to give evidence in court if the case can’t be settled earlier. If this happens then the team at TJL will be at your side throughout, to ensure that the court hears the fullest possible account of how your injuries happened and the impact they have had.
