Public place injury claims

We are experienced dealing with accidents in a public place

If you’ve been injured in an accident in a public place that wasn’t your fault then you may be able to make a compensation claim. Accidents in a public place can happen almost anywhere, from shops or gymnasiums to bars, restaurants or open public spaces.

If you slip or fall in a supermarket, injure yourself on faulty gym equipment or trip over a loose paving stone your injuries could have been caused because someone else was negligent. If this is the case the team at TJL will do everything they can to build a claim for the compensation you’re entitled to.

We understand that a compensation payment can never truly make up for being let down and injured in this way, but it can act as a marker for the fact that you were badly let down while simply going about your day to day life. At the same time, compensation can make sure that you don’t suffer financially, as well as physically and psychologically.

If the party with a duty of care to anyone using a public place fails in that duty of care they have been negligent. If this leads to you being injured, you have every right to seek compensation, and the team at TJL will do all we can to make sure you get what you’re entitled to.

How Much Compensation Could I Get for an Accident in a Public Place?

The amount of compensation awarded for a successful claim following an accident in a public place will vary, from a few thousand pounds for minor injuries up to more than a million for injuries which are life-changing and will require on-going care and medical attention.

When we work on your compensation claim we’ll estimate the likely compensation pay-out once we’ve clearly established the details of your case. If the estimated amount changes as the claim progresses – i.e. if more details of your injuries emerge – we will keep you fully up to date and informed.

In all cases following accidents in a public place the compensation will be made up of general damages and special damages.

General Damages

General damages are intended to reflect the nature of the injuries you have suffered, and the impact those injuries have had and will continue to have. Factors taken into account include:

  • The pain and distress you have been through, both physically and psychologically
  • The injuries you have received and how severe they are
  • Whether you are expected to make a recovery in the future
  • The degree to which the injuries stop you from enjoying things like hobbies, pastimes and family life in general

The final figure will be reached with the help of a publication called the Judicial College Guidelines (JCG), which includes a suggested compensation range for specific injuries, depending on their long term prognosis.

Examples in the JCG include the following:

  • Minor permanent damage to vision in one or both eyes - £7,780 to £17,900
  • Fractured leg with good, but not full recovery £21,920 - £33,880
  • A wrist injury which causes permanent pain and stiffness - £10,750 to £20,900
  • A minor neck injury - Up to £6,680

The Definition of an Accident in a Public Place

In legal terms a public place is one which the public can access. Common examples of public places where an accident could happen include:
  • Pubs, clubs and bars
  • Supermarkets, shopping malls and other retail outlets
  • Pavements, walkways, footpaths and other open spaces such as parks and playgrounds
  • Car parks
  • Cafes and restaurants
  • Gymnasiums
  • Sporting venues or performing arts arenas

In any public place there will be a party with a duty of care to those able to access that place. This could be the management of a pub or bar, or the local authority with oversight of a playground.

If you contact TJL following an accident in a public place we’ll be able to identify the body or persons responsible for that space, and whether we think they have been negligent. The accidents in a public place that form the basis of the compensation claims we handle could include the following:

  • Slipping on spilled liquid which hasn’t been cleared or cordoned off in a bar or pub
  • Tripping on an unmarked step in a restaurant or club
  • Falling over unattended debris on the floor of a supermarket
  • Being hit by items falling from a badly stacked shelf in a shop
  • Falling after stepping into a pothole on a pavement
  • Being hurt while using faulty equipment in a gymnasium
  • Having hot food or drink spilled on you in a café
  • Having a chair collapse under you in a pub, restaurant, café etc.

Special Damages

Special damages are included in any compensation payment to take account of the financial impact of your injuries.

They are calculated to ensure that you are not left in a worse financial position than you would have been if the accident had never happened.

Damages of this kind are meant to cover the loss of any earnings or pension caused by the impact the injuries have on your ability to work for a living. They also compensate for any expenses directly related to the injuries, such as the following:

  • Money you have to spend on medical treatment, now and in the future
  • Money you have to spend buying in care provision, now and in the future
  • Am amount intended to cover the time given up free of charge by members of your family or friends who help with your care requirements
  • Money spent on specialised equipment needed, such as a wheelchair, crutches or a mobility scooter
  • Money you have to spend on modifying your living space or vehicle to allow for the permanent impact of your injuries
  • The cost of traveling to and from any injury-related medical appointments
  • The cost of any counselling or therapy you have to access

Time Limits for Claiming After an Accident in a Public Place

The legal time limit for claiming compensation following an accident in a public place is 3 years after the accident happens. The few exceptions to the 3 year rule include the following:

  • You were under 18 years of age at the time of the accident, in which case the 3 year limit will run from your 18th birthday to your 21st birthday
  • You were mentally incapacitated at the time of the accident in a public place, and unable to claim within 3 years. The 3 year limit will then run from the date on which you are no longer mentally incapacitated.

Despite the 3 year limit being in place we would always recommend starting the compensation claim process as soon as possible after your accident in a public place.

The Claims Process for Accidents in Public Places

We understand that working through a compensation claim could be the last thing you want to think about when recovering from an accident in a public place.

We know how traumatic and distressing it can be to be injured in this way, particularly if it only happens because someone was negligent.

Our commitment to getting the compensation you deserve is combined with taking the stress and work of the compensation claim out of your hands, leaving you to concentrate on recovering. One of the ways we do this is by breaking the claims process down into a series of more manageable individual steps:

  • Immediately following an accident in a public place you should seek medical attention for your injuries, accessing the right treatment and creating an official record of your accident
  • You should report your accident to the party you think is responsible for the public place. For a retail outlet, gym or restaurant this will mean making a report to the management, who may have an accident book to fill in.

If the public place was the responsibility of a local authority, you should email them with an account of your accident as soon as you are able to.

  • You should gather evidence of the accident, such as photographs of the public place and in particular the issues which contributed to your accident
  • You should take the contact details of any witnesses to your accident
  • You should contact TJL with an account of your accident in a public place. If we think you have the grounds for a compensation claim we’ll explain the process and get to work right away.
  • We’ll take a detailed statement from you, explaining how and where the accident happened and detailing the injuries you suffered and the impact they have had on your life.
  • We’ll arrange an in-depth medical evaluation with an independent expert. This will enable us to ascertain the full extent of your injuries and the prognosis for any recovery
  • We’ll pull together the evidence needed for a successful compensation claim. This evidence could include:
    • Your own detailed statement of what happened and the result of the independent medical evaluation
    • Your medical records following the accident in a public place, particularly any treatments linked to the injuries suffered in the accident
    • Any official records of the accident created by police or ambulances attending
    • Statements from any witnesses to the accident
    • Any photographs taken at the scene of the accident, either at the time or subsequently
    • If the scene of the accident is covered by a CCTV camera we will attempt to get hold of the footage
    • Any evidence which indicates that the party responsible for the public place should have been aware of the risk of an accident. This could include previous entries in an accident book or complaints made to a local council.
    • Your own personal diary setting out the impact of your injuries on all aspects of your life and details of the recovery process
    • Any evidence to show that your injuries have led to lost earnings, such as wage slips and bank statements showing the situation before and after the accident in a public place
    • Paperwork to demonstrate the money you’ve had to spend which is directly linked to the accident in a public place, such as receipts, bills and invoices
  • Once the evidence has been gathered we’ll contact the party responsible for the public place in which your accident happened to tell them that you are going to claim compensation. We’ll outline the evidence that supports your claim and why we think they have been negligent.
  • In many cases the other party will admit liability at this stage, faced with our track record of fighting successful compensation claims and the strength of the case we’ll put forward. We always try to settle claims as quickly as possible, using our skill in dispute resolution to avoid having to go to court.
  • If liability is admitted we’ll negotiate a fair compensation payment. We know exactly what kind of expenses can be claimed for and how the injuries you’ve suffered should be reflected.

We never settle for anything less than 100% of the compensation you deserve, which is why we’ve managed to win more than £43 million for our clients. If it takes longer than usual to agree compensation – perhaps because of the complexity of your injuries – we will apply for interim payments to help you cope until the process is completed.

  • In rare cases the claim has to be settled in court, because the other party won’t admit liability or refuses to make a fair compensation offer. If this happens the expertise of the TJL team will be more valuable than ever, as we stand by your side and present your case forcefully and clearly.

How to Make a Personal Injury Claim

Most personal injury claims follow a similar process, whether you were hurt at work, in a road traffic accident, while cycling, or in a public place. But no two claims are exactly the same.

What Counts as a Personal Injury Claim?

A personal injury claim can arise when someone else’s negligence causes your injury. This could be a careless driver, an employer, or a business that failed to fix a dangerous condition. But whether you have grounds to make a claim depends on how the accident happened and who is responsible. Not every accident necessarily leads to a valid personal injury claim.
