Root canal treatment may be needed if you have a bacterial infection in a tooth. The bacteria is removed and the tooth sealed back up, a complex process requiring high levels of skill and expertise from your dentist.

If something goes wrong with your treatment then you may be able to claim failed root canal compensation. A failed root canal can be extremely painful and distressing, and can require further expensive treatment to correct.

If this happens because your dentist failed to meet the standards expected of a competent professional then you could be able to claim for dental negligence. If you’ve had root canal treatment that went wrong, contact the experts at TJL Solicitors, and if we think your dentist was negligent, we’ll work with you to claim any failed root canal compensation you might be entitled to.

How much compensation could I get for a failed root canal claim?

The exact amount of money paid for a failed root canal compensation claim will be made up of general damages and special damages, and could range from a few thousand pounds to tens of thousands. The general damages cover the pain and suffering caused by the treatment and the impact it has had on your ability to live your life.

This figure will be reached with the help of a publication called the Judicial College Guidelines (JCG). This specialist guide sets out compensation ranges for specific injuries in compensation claims of this kind.

Once we have a full picture of the impact of your failed root canal treatment we’ll be able to estimate how much you might receive in general damages.

Special damages compensate for the financial impact of the failed root canal treatment. This includes the cost of any restorative treatment, compensation for any lost earnings and out of pocket costs directly linked to the negligent treatment.

Once the experts at TJL have a full understanding of the nature of your failed root canal and the impact it has had we’ll be able to provide you with a detailed estimate of the compensation we think you should be entitled to. Once we have a figure in mind we always negotiate for 100% of the money you deserve.

Examples listed in the current edition of the JCG include:

  • Loss of two front teeth - £5,310 to £9,310
  • Loss or serious damage to several front teeth - £10,660 to £13,930
  • Loss or severe damage to one front tooth - £2,690 to £4,820

What to do to claim failed root canal compensation

The first thing you should do if you think you might be eligible for failed root canal compensation is consult another dental professional.

As well as treating you for any pain or discomfort you might be in, another dentist will be able to confirm if the root canal treatment has failed.

Once you know the root canal treatment has failed you should complain directly to the dentist in question. This will create an official record of your failed root canal, and their response will form part of your failed root canal compensation claim.

After making an official complaint you should contact the experts at TJL. After an initial free consultation we will be able to decide, on the basis of our extensive experience of dental negligence claims, whether you have the grounds for a failed root canal compensation claim.

If you are eligible to claim compensation for your failed root canal then we’ll work with you to prove negligence and win the compensation we think you are entitled to.

What will failed root canal compensation claim include?

The compensation paid for a successful failed root canal compensation claim will include amounts based on the following factors:
  • The pain and suffering the failed root canal treatment has put you through, in physical and psychological terms
  • The impact the failed root canal treatment has had on things like your ability to sleep, eat, socialise and work
  • Any injury to your mouth which has happened or been made worse because of the failed root canal treatment
  • Any further treatment required to deal with the aftermath of your failed root canal treatment
  • The emotional fall-out from your failed root canal treatment, which could include anxiety, stress, trauma and a loss of confidence
  • Any earning lost because recovering from the failed root canal treatment involved having to take time off work
  • Any money which you only had to spend as a result of the failed root canal treatment, such as travel costs to and from specialist dental appointments to put things right

What can go wrong with root canal treatment?

Root canal treatment is one of the more complex procedures a dentist might carry out on a patient.

This complexity means that there are a number of things that can go wrong, particularly if your dentist fails to meet the duty of care they have to you as a patient.

Some of the more common examples of negligence which could cause a root canal procedure to fail include the following:

  • Your dentist fractures an instrument such as a drill inside the root canal and fails to inform you of fragments left behind
  • Your dentist doesn’t remove all of the infection present in the root canal
  • Your dentist doesn’t properly clean and disinfect the root canal following treatment
  • Your dentist penetrates the side of your tooth with an instrument
  • Your dentist perforates the root of your tooth with an instrument
  • Your dentist fails to properly seal the root canal following treatment, something which carries a risk of re-infection
  • Your dentist fails to gain informed consent for the root canal treatment, meaning they don’t explain the process and the risks involved clearly and in detail

This is not an exhaustive list, and if you think your treatment failed for any reason whatsoever you should contact TJL to discuss the possibility of starting a failed root canal compensation claim.

How to Make a Personal Injury Claim

Most personal injury claims follow a similar process, whether you were hurt at work, in a road traffic accident, while cycling, or in a public place. But no two claims are exactly the same.

What Counts as a Personal Injury Claim?

A personal injury claim can arise when someone else’s negligence causes your injury. This could be a careless driver, an employer, or a business that failed to fix a dangerous condition. But whether you have grounds to make a claim depends on how the accident happened and who is responsible. Not every accident necessarily leads to a valid personal injury claim.

Do I Have A Dental Negligence Claim

Your dentist was supposed to fix a problem. Instead, you’re dealing with the consequences of dental treatment that left you worse off, like suffering constant pain or needing further procedures. You want to know: do I have a dental negligence claim?

How do I know if my root canal treatment has failed?

You will know if your root canal treatment has failed if the normal levels of pain and discomfort present once any anaesthetic has worn off continue or worsen after a period of two to three days.

Other signs that your root canal treatment has failed in some way include the following:

  • Pain which is worse than mild discomfort and lasts for longer than a few days. Any pain lasting longer than this or getting worse as time passes is a sign that bacteria in the root canal has triggered an infection.
  • If the area around the root canal treatment becomes highly sensitive to hot or cold temperatures it could be a sign that the root canal treatment has failed.
  • If the area around the root canal treatment swells and/or becomes painful it could indicate an abscess or other form of infection. The same is true if you notice pus in that area of your mouth.
  • Even if pus or discharge is present without any pain or swelling it could indicate a failed root canal treatment.

If you have any of these symptoms or a combination of two or more you should seek medical attention as soon as possible. An x-ray will be able to establish what has happened to the root canal and what needs to be done to put things right.

The cost of this treatment will then form a part of a failed root canal compensation claim.

Can I make a failed root canal compensation claim?

You can make a failed root canal compensation claim if you are able to show two things:
  • Your dentists failed to meet their duty of care to you by not providing the standard of treatment you would reasonably expect from a qualified professional
  • As a result of this negligence your root canal treatment failed, causing injury such as physical pain and psychological trauma

Any treatment which falls below reasonably expected standards could form the basis of a failed root canal compensation claim, but some of the more common examples of dental neglect during root canal procedures include the following:

  • Your dentist failed to properly identify the infected tooth or establish the amount of infection present before starting the treatment
  • The treatment failed because of a technical error, such as damaging the surrounding teeth, over or under filling the root canals or leaving some of the infected bacteria behind
  • Your dentist failed to properly sterilise the root canal before or after treatment, or used instruments which weren’t fully cleaned. As a result the root canal became infected.
  • Your dentist failed to arrange sufficient follow-up appointments at which they could monitor your recovery and check for early signs that the root canal had failed
  • Your dentist delayed diagnosing the infection in the root canal or failed to spot it at all, leading to the infection spreading, the loss of a tooth or unnecessary pain

What is the claims process for failed root canal compensation?

We realise that starting a compensation claim might be the last thing on your mind when you’re recovering from failed root canal treatment.

To make things easier, break the claims process down into a series of individual steps.

We then guide you through those steps in a caring and supportive manner, giving you the space to concentrate on getting over your negligent treatment while we work to win the compensation we think you’re entitled to.

Step 1 – An initial consultation during which we listen to your experiences and decide whether you have strong grounds to make a failed root canal compensation claim

Step 2 – We take a detailed statement from you describing the treatment you received and the impact the failed root canal has had on your life

Step 3 – We arrange an evaluation with an independent dental expert. This will provide a full picture of what went wrong with your root canal treatment, what the prognosis for any recovery is and the nature and extent of any further treatment you will require.

Step 4 – We pull together the evidence to support your claim. This could include:

  • Photographs of the aftermath of the failed root canal treatment
  • Witness statements from friends and family describing the impact the treatment had on you
  • Your dental records from before and after the failed root canal treatment
  • Medical records relating to the failed root canal, such as pain relief or antibiotics being prescribed or any therapy accessed to deal with psychological trauma
  • Documents relating to the financial impact of the failed root canal treatment, such as wage slips, receipts for direct expenses and bank statements

Step 5 – We will contact the other party to tell them that you are making a failed root canal compensation claim. In all our cases we place the emphasis on dispute resolution and reaching an agreement without going to court.

The majority of times the other party accepts liability as this stage in the process.

Step 6 – We will negotiate a compensation settlement based on our understanding of the physical, psychological and financial impact of your negligent treatment. Although we aim to settle root canal compensation claims as quickly as possible, we never accept less than 100% of the compensation we think you are entitled to.

Step 7 – A very small number of claims have to be settled in court. If this happens we will be by your side throughout, guiding you through the proceedings and arguing your case clearly and firmly.

Is there a time limit on root canal compensation claims?

Yes, there is a legal time limit on root canal compensation claims. It is 3 years from the date of the root canal treatment, or the date on which it became apparent that the root canal treatment had failed.

After this 3 year period you will no longer be able to claim compensation for a failed root canal, with the following exceptions:

  • If you were under 18 at the time of the treatment the 3 years will run from your 18th birthday to your 21st
  • If you lack the mental capacity to make a claim during the 3 years the time limit will run from the date on which you regain that capacity

Despite the 3 year limit we would always recommend starting a failed root canal compensation claim as soon as possible after the failure becomes apparent. The sooner you start a claim the sooner you will get any compensation you are entitled to, and gathering the evidence will be easier in the immediate aftermath of the treatment.

Failed Root Canal FAQs

Can I make a no win no fee root canal compensation claim?

Yes, you can make a no win no fee root canal compensation claim with TJL. This means that you pay nothing as we process your claim, gather the evidence, arrange a dental evaluation and negotiate with the other party.

We only take a fee if your claim is successful and the compensation has been paid. If the claim fails then you’ll pay us nothing, and the costs of the other party will be covered by insurance we take out on your behalf.

How long will a failed root canal claim take?

Depending on the details of your case a failed root canal claim could take between 12 months and 3 years from the date on which you contact TJL. Longer claims usually result from the other party failing to admit liability, or being unwilling to make a fair compensation offer.

In all cases we will work to settle your claim as quickly as possible, and will keep you fully up to date with the predicted timetable throughout.

Does a failed root canal always result in extraction?

A failed root canal doesn’t always lead to an extraction of the tooth in question. Alternatives include a second root canal procedure being carried out or other dental surgery which can clear any infection while saving the tooth.

If all else fails, however, extraction will be regarded as the last resort and only treatment option.
