August 2007 - Stairway fall
A woman who fell down a stairway has been awarded over £100,000 in compensation.
Agnes Wilson, was walking down a stairway near her high-rise home when one of the steps wobbled and she fell, breaking her arm and sustaining a serious bump on the head. She was unable to recall the incident when she woke up in hospital.
A couple had passed Mrs Wilson as she was approaching the stairs, and then heard her scream.
James Saunders, a neighbour of Mrs Wilson, gave evidence in court that he had complained to Glasgow City Council about loose steps on a previous occasion, but the Council maintained there was no problem and Mrs Wilson should have been more careful.
The judge, accepted Mr Saunders' evidence and found the Council liable, but reduced the provisional compensation figure by 25 per cent to £108,750, as he found Mrs Wilson to be partly responsible for the accident.
Tanveer Jaleel, senior partner at TJL Solicitors comments: “Even if the accident is partly your fault, you could still be entitled to compensation. Our legal experts are on hand to provide honest and professional advice regarding personal injury claims, and they work hard to get our clients maximum compensation with minimum fuss.”
