Man slips on florist's petals

A commuter has won the right to damages after he slipped on a petal on the pavement outside a florist’s shop, falling and damaging his back.

Brian Piccolo, 50, was walking past Chiltern Flowers at Marylebone Station in London when the accident occurred, which initially caused some paralysis and hospitalised him for six months.

Mr Piccolo brought a claim for negligence against Chiltern Flowers, and against Chiltern Railway Company, which had overall responsibility for running the station.

Chiltern Flowers were ruled liable for the accident. However, Chiltern Railway Company was cleared of any wrongdoing as it had previously contacted the shop regarding the potential hazard of debris to commuters.

Tanveer Jaleel, senior partner at TJL Solicitors comments: “The shop had a duty of care to those passing by and it had breached that duty by failing to implement an effective cleaning system..

“If you’ve been injured in the street, at someone else’s house, business, or any other public place, then you may be able to make a claim. Wherever your injury occurred, if there was no public sign to warn you of the danger, then you could be entitled to compensation.”
